Whilst at the arbitration Mr. Barry Van Geffen stated quite categorically that he would NOT pay any award made against him (Laurent Giles).
They have in fact transferred all the assets out of the company including the name, the company is now called "Briefgoals" and has gone into voluntary liquidation, thus ensuring that Peter and Frances Tate do not get any of their award.

A Panel of Inquiry has determined that a prima facie case has been made against Mr. S. Wallis and a full disiplinary board will therefore be convened to consider the allegation of improper professional conduct, at which Mr. Wallis will have the opportunity of being heard.
Mr. B. Van Geffen is NO LONGER A MEMBER so no action will be taken against him !!!!

Dear Mr Tate,

Allegation of improper professional conduct against a member.

I understand from our telephone conversation that you have not received my letter, sent to the above address, informing you of the findings of the Disciplinary Board, convened to consider your allegation of improper professional conduct by a member.

The Council of the Institution accepted the findings of the Disciplinary Board, and reprimanded the member for failing to display the level of professional competence and care expected of a member of his experience. Specifically, the Council concluded that the member had failed to take proper and adequate steps to ensure that reasonable skill and care in, and about, the preliminary design work and preparation of the design proposal was exercised. It was found that insufficient steps were made to check that the design worked in practice, thus allowing for the correction of any errors. The Council also concluded that the member failed to protect the interests of his client by having professional indemnity insurance. The Council found no evidence of any other improper professional conduct by the member in this matter.

In view of the time which has elapsed since the contract was signed, the time taken to make the allegations, the lack of documentary evidence on matters other than related to the design of the boat, and the member’s limited personal involvement in the design, the Council also decided not to make any public announcement of their decision or release details of the Disciplinary Board’s findings.

Dear Mr Tate,

I have received your most recent letter concerning your complaint about a member of the Institution.

I must correct some of the points you make in your letter. Firstly, you were “requested” to wait outside while the Disciplinary Board questioned Mr Tate and not “directed” as you state. You were informed that you would not be able to be present whilst the Board interviewed the member, following your evidence .This questioning lasted for more than the half hour you state in your letter.

Perhaps most significantly, I did not state that the member had “admitted responsibility to all your complaints.” Indeed, I informed you that you would be advised of the Board’s finding at a later date.

The Board considered the number of possible instances of improper professional conduct which were implicit in your complaint, and found evidence to support only two of them, as stated in my last letter. The Council’s reasons for not making the findings of Board public were also explained in the final paragraph of my letter. Public announcement of the findings would have imposed a greater level of “punishment” on the member, which the Council did not feel was warranted, given the circumstances described in my letter.

I believe the Institution has acted properly and fairly in this matter, having given equal consideration to their duty to you and to its member. I regret I cannot enter into further correspondence on this matter.
